جنيف- أعرب المرصد الأورومتوسطي لحقوق الإنسان عن بالغ قلقه إزاء استمرار اعتقال سلطات إقليم كردستان العراق عشرات الناشطين والنقابيين على خلفية الاحتجاجات الشعبية التي اندلعت في أغسطس/آب 2020 بسبب الأزمة الاقتصادية التي تسببت بارتفاع نسب الفقر والبطالة في الإقليم النفطي.
    اعتُقل شقيقي شفان بتاريخ 22 أكتوبر 2020 بطريقة غير قانونية من خلال قوة أمنية مقنعة مجهولة، ومنذ ذلك الوقت وهو رهن الاعتقال في سجن "الأسايش" ويعاني من ظروف اعتقال سيئة

وقال المرصد الحقوقي الأوروبي في بيانٍ صحفيٍ اليوم الأحد، إنّ 26 ناشطًا ونقابيًا ما يزالون رهن الاعتقال في سجن يتبع لقوات الأمن الداخلي (الأسايش) في محافظة أربيل، بعد اعتقالهم من مسلحي الحزب الديمقراطي الكردستاني (حدك) والقوات التابعة لرئيس وزراء الإقليم مسرور بارزاني منذ 13 أغسطس/آب 2020.
وأوضح الأورومتوسطي أنّ المعتقلين يعانون من ظروف احتجاز غير إنسانية، إذ يجبرون على الاعتراف بالتهم المنسوبة إليهم تحت التعذيب البدني والنفسي الشديد على أيدي قوات "الباراستن" – وهو جهاز الاستخبارات- التابع للحزب الديمقراطي (حدك).
وفي إفادة لفريق المرصد الأورومتوسطي، قال الناشط المدني "إيهان سعيد"، وهو شقيق المعلّم المعتقل "شفان سعيد": "اعتُقل شقيقي شفان بتاريخ 22 أكتوبر/تشرين الأول 2020 بطريقة غير قانونية من خلال قوة أمنية مقنعة مجهولة، ومنذ ذلك الوقت وهو رهن الاعتقال في سجن "الأسايش" ويعاني من ظروف اعتقال سيئة من تعذيب جسدي ونفسي متواصل كما أخبرنا بذلك المحامي الذي سُمح له بزيارته بعد معاناة كبيرة، في حين لم يسمح لنا كعائلته بزيارته حتى الآن".
وأضاف "يواجه شقيقي تهمًا خطيرة من بينها "الانقلاب على سلطة الإقليم"، كما أنني أواجه نفس التهمة الموجهة لشقيقي، إذ قُدمت لائحة اتهام ضدي بذات التهمة، ما اضطرني للمغادرة صوب السليمانية خوفًا من اعتقالي، فضلاً عن أن هناك محاولات للضغط على المحكمة من أجل إصدار قرار غيابي بحقي للضغط عليّ لأتوقف عن المطالبة بالإفراج عن شقيقي وبقية المعتقلين".
وفق معلومات اطلع عليها المرصد الأورومتوسطي، تستمر (الأسايش) باحتجاز بعض المعتقلين رغم صدور قرارات بالإفراج عنهم، مثل الناشط النقابي المعلم "بدل برواري" -أُجبر على تسليم نفسه بعد اختطاف نجله وتعذيبه- الذي أصدرت محكمة الاستئناف في دهوك قرارًا بالإفراج عنه ولكنّه ما يزال معتقلاً حتى الآن.
وحصل الأورومتوسطي على نسخة من قرار قضائي بتاريخ 4 أكتوبر/تشرين الأول 2020 صادر عن محكمة الاستئناف بدهوك يقضي بتبرئة الناشط "برواري" من التهم المنسوبة إليه وغلق الدعوى وإخلاء سبيله.
وأفادت الصحفية والناشطة الحقوقية "نياز عبد الله" لفريق الأورومتوسطي أنّ "المعتقلين يواجهون ظروفًا صعبة للغاية. فعلى سبيل المثال، اعتقل الصحفي "شيروان شيرواني" من منزله وأمام أطفاله بتاريخ 7 أكتوبر/تشرين الأول 2020، حيث تم إيداعه لمدة شهرين في السجن الانفرادي، وتم أخذ اعترافات غير صحيحة منه تحت التعذيب، وأرغموه على فتح هاتفه وحاسوبه الشخصي وأخذوا كل الملفات الموجودة فيهما، ولم يسمح له بمقابلة محاميه إلا مرة واحدة لمدة قصيرة وتحت مراقبة ضابط أمني. كما نقل محاميه أن الاعترافات المكتوبة في ملف القضية تحوي أمورًا لم يذكرها "شيروان" في اعترافه الذي انتُزع تحت التعذيب، ويواجه اليوم تهمة التجسس لصالح جهات أجنبية، فضلاً عن أنه يواجه ضغوطًا نفسية كبيرة بسبب وفاة والده أثناء وجوده في السجن".
ولفت الأورومتوسطي إلى أنّ السلطات سمحت أخيرًا لعدد محدود من أهالي المعتقلين بزيارتهم لمرة واحدة ولمدة 10 دقائق فقط وتحت مراقبة قوات الأمن، إذ لاحظ الأهالي ترديًا كبيرًا في صحة المعتقلين، لدرجة أنّ بعض العائلات لم تتمكن من التعرف على أبنائها.
وقال الباحث القانوني لدى المرصد الأورومتوسطي "عمر العجلوني إن "سلطات إقليم كردستان العراق ملزمة باحترام الحريات السياسية للمواطنين وعدم انتهاك حقهم في التعبير عن آرائهم، وهذا ما أكد عليه الدستور العراقي والعهود والمواثيق الدولية ذات العلاقة، حيث جاءت المادة (38) من الدستور العراقي لتكفل للمواطنين ممارسة حريتهم في التعبير عن آرائهم حينما نصت على أنه "تكفل الدولة، بما لا يخل بالنظام العام والآداب: أولاً:- حرية التعبير عن الرأي بكل الوسائل. ثانياً:- حرية الصحافة والطباعة والإعلان والإعلام والنشر. ثالثاً:- حرية الاجتماع والتظاهر السلمي، وتنظم بقانون"، وهو ذات الأمر الذي نصت عليه المادة (19) من الإعلان العالمي لحقوق الإنسان والتي جاء فيها "لكل شخص حق التمتع بحرية الرأي والتعبير، ويشمل هذا الحق حريته في اعتناق الآراء دون مضايقة، وفى التماس الأنباء والأفكار وتلقيها ونقلها إلى الآخرين، بأية وسيلة ودونما اعتبار للحدود".

ودعا المرصد الأورومتوسطي سلطات إقليم كردستان العراق إلى الإفراج الفوري وغير المشروط على جميع المعتقلين على خلفية الاحتجاجات الشعبية، وفتح تحقيق فوري في حوادث التعذيب داخل مراكز الاحتجاز، ومحاسبة جميع المتورطين في تلك الممارسات غير القانونية، والتوقف عن تقييد ممارسة المواطنين لحقوقهم وحرياتهم، وفي مقدمتها الحق في التجمع السلمي والحق في التعبير عن الرأي.
وحثّ الأورومتوسطي السلطات على الالتزام بالدستور والعهود والمواثيق الدولية والقوانين المحلية ذات العلاقة، والكف عن الاستخدام التعسفي للقوانين لمعاقبة المواطنين على ممارستهم لحقوقهم المشروعة، واحترام استقلالية القضاء، وعدم استخدامه للانتقام من المعارضين والنشطاء المدنيين.
Torture and illegal detention of protesters in Iraqi Kurdistan
Geneva: The Euro-Mediterranean Observatory for Human Rights has expressed deep concern that dozens of activists and trade unionists continue to be detained by the Kurdistan Region authorities in connection with popular protests in August 2020 over the economic crisis that has caused high poverty and unemployment in the oil region.
My brother Schwan was arrested on October 22, 2020 illegally through an unknown disguised security force, and since then he has been detained in Al-Asaish prison and is suffering from poor conditions of detention.

The European Observatory for Human Rights said in a press release on Sunday that 26 activists and trade unionists have been detained in a prison belonging to the Internal Security Forces (Asayish) in Erbil province, after they were arrested by The Kurdistan Democratic Party (KDP) militants and forces of the region's Prime Minister Sa'er Barzani since August 13, 2020.
The Euro-Mediterranean explained that the detainees suffer from inhumane conditions of detention, as they are forced to confess to the charges against them under severe physical and psychological torture at the hands of the "Barstan" forces, the intelligence service of the Democratic Party (Hadak).
"My brother Schwan was unlawfully arrested on 22 October 2020 by an unknown disguised security force, and since then he has been detained in Al-Asaish prison and has suffered from poor conditions of physical and psychological torture, as told by the lawyer who allowed him to visit him after great suffering, while he has not yet allowed us as his family to suffer," said civil activist Ihan Said,brother of detained teacher Shafan Said.
"My brother faces serious charges, including a coup against the territorial authority, and I am facing the same charge against my brother, as I filed an indictment against me on the same charge, which forced me to leave for Sulaimaniyah for fear of arrest, and there are attempts to pressure the court to issue a decision in my absence to pressure me to stop demanding the release of my brother and the rest of the detainees," he said.
According to information seen by the Euro-Mediterranean Observatory, The Asaish continues to detain some detainees despite decisions to release them, such as trade union activist Al-Muallem "Badal Barwari" - forced to surrender after his son was kidnapped and tortured - who was sentenced by the Court of Appeal in Duhok but is still detained.
The Euro-Med obtained a copy of a court order issued on October 4, 2020 by the Court of Appeal in Dohuk, acquitting the activist Barwari of the charges against him and closing the case and releasing him.
"The detainees face very difficult circumstances," journalist and human rights activist Niaz Abdullah told the Euro-Mediterranean team. For example, journalist Sherwan Shirwani was arrested at home and in front of his children on 7 October 2020, where he was held for two months in solitary confinement, took false confessions from him under torture, forced him to open his phone and personal computer and took all the files in them, and was allowed to meet his lawyer only once for a short period under the supervision of a security officer. His lawyer also said that the confessions written in the case file contained things that Sherwan did not mention in his confession, which was extracted under torture, and now faces charges of spying for foreign actors, as well as facing considerable psychological pressure due to the death of his father while in prison."
He pointed out that the authorities finally allowed a limited number of families of detainees to visit them once and for only 10 minutes under the supervision of the security forces, as the parents noticed a significant deterioration in the health of the detainees, to the extent that some families were unable to identify their children.
"The authorities of the Kurdistan Region of Iraq are obliged to respect the political freedoms of citizens and not violate their right to express their opinions," said Omar al-Ajlouni, a legal researcher with the Euro-Mediterranean Observatory. First: - Freedom of expression by all means. Second: Freedom of the press, printing, advertising, media and publishing. Third: Freedom of assembly and peaceful demonstration, regulated by law," the same article (19) of the Universal Declaration of Human Rights, which states that "everyone has the right to freedom of opinion and expression, and this right includes the right to hold opinions without harassment, to seek, receive and transmit news and ideas to others, by any means and without regard to borders."
Denying detainees fair trial guarantees by forcing them to confess to charges under torture and denying them the vision of their relatives indicates that there are "retaliatory intentions" to punish them for their peaceful practices and undermines freedom of opinion and expression in the region

He added that denying detainees fair trial guarantees by forcing them to confess to the charges against them under torture and denying them the vision of their relatives indicates that there are "retaliatory intentions" to punish them for their peaceful practicesand undermines freedom of opinion and expression in the region.
The Euro-Mediterranean Observatory called on the Authorities of the Kurdistan Region of Iraq to immediately and unconditionally release all detainees in connection with popular protests, to open an immediate investigation into incidents of torture inside detention centres, to hold accountable all those involved in these illegal practices, and to stop restricting citizens' exercise of their rights and freedoms, notably the right to peaceful assembly and the right to express opinions.
He urged the authorities to abide by the constitution, international covenants, international conventions and relevant domestic laws, stop using laws to punish citizens for exercising their legitimate rights, respect the independence of the judiciary, and not use it to retaliate against civilian dissidents and activists.
